Site7

Working draft. A required contact detail is still a placeholder in src/legal/identity.ts or src/content/config.ts. Until that is fixed, this page is not indexed by search engines.

Terms of use

What the prices shown mean, what the demos are, and how far our liability goes toward a visitor.

1. Who operates this site

site7.ca is operated by Groupe Bien-aimé (Quebec enterprise number 2282430406), doing business as Site7, [NUMÉRO] rue Birnam, Québec, QC, [CODE POSTAL]. To reach us: john@email.site7.ca or 514 623-6847.

By using this site you accept the terms below. If they do not suit you, do not use the site.

2. What this site is, and what it is not

This site presents a website design service. Its content is provided for information.

Nothing on this site is a binding offer, a contract, or professional legal, accounting or technical advice for your situation. A commitment exists only once a written quote is accepted and payment is received.

3. The prices shown

Prices are in Canadian dollars and are before tax. GST and QST are added on the invoice, at the rates in force. The all-in amount is shown under every price on the pricing page. Our registration numbers: GST [NUMÉRO DE TPS], QST [NUMÉRO DE TVQ].

Those prices cover what the package describes. Anything outside that description is quoted separately and accepted in writing before work starts. Prices may change going forward; the price confirmed in your quote is the one that applies to your project.

Domain names, third-party hosting and photo or font licences are paid to their supplier, at that supplier's price. They are listed separately in the quote when they apply.

4. Payment and refunds

Payment is made by credit card, through a Stripe link, or by Interac e-Transfer. Fixed-price packages carry a payment link on the pricing page; the others receive a link created for their quote. The payment itself happens entirely with Stripe: no card data passes through site7.ca and no payment is processed there.

The package is paid in a single payment. The mockup is free and carries no commitment: nothing is ever owed before you have seen it. A client who prefers to pay right away may do so, but is never required to, and paying up front removes none of the rights set out below.

Refunds: the client has 48 hours after payment to cancel and be refunded in full, as long as production has not started. Once production has started, the amount is retained in consideration of the work performed.

After launch there is no refund, but any technical defect reported within 30 days is fixed at no charge. No refund is given for a commercial outcome, such as a Google ranking or a number of calls, which is never guaranteed.

Turnaround guarantee: if delivery runs past 7 business days for a reason attributable to us, the client gets back 10% of the package price for each business day late, up to 50%. The clock starts when complete content is received, on a date confirmed in writing; waiting on something the client must supply is not a delay attributable to the supplier.

Monthly services are separate subscriptions, taken out separately by the client. They can be cancelled at any time and end at the close of the period already paid for, with no penalty and no partial refund of the current month. The hosting subscription includes up to 30 minutes of changes per month; beyond that, time is billed at $75 per hour, quoted to the client before it is spent.

5. The demonstration sites

The demo pages show fictional businesses. The names, text, addresses, opening hours, prices and images on them are invented to demonstrate a layout.

They are not clients. They are not real businesses. Any resemblance to an existing business is coincidental. Every demo page carries a banner saying so, and those pages are excluded from search engine indexing.

6. Displayed capacity and turnaround

The number of remaining spots shown on the home page is a real figure, updated by hand. There is no automatic counter and no timer. Because it is updated by hand, it can be a few days behind: the quote confirms a spot, the banner does not.

The turnaround announced counts business days starting when complete content is received, not at signature. A delay waiting for text, photos, access or an approval pushes delivery back by the same amount.

7. Testimonials

A testimonial is published only after written approval from the person quoted, and that approval is kept on file. No testimonial is invented, bought or reworded after approval. If a quote concerns you and you want it taken down, write to us and it comes down, no argument.

8. Intellectual property

The content of this site, including text, code, layout, logo and the Site7 name, belongs to us or is used with permission. You may read the site, print a page and share it by link.

You may not copy the site or a substantial part of its content for use in a competing commercial offer, or remove ownership notices.

What belongs to a client under a paid project is a separate question, settled in the service agreement, not here.

9. No warranty on the site itself

This site is provided as is. We make a reasonable effort to keep it accurate and available, without guaranteeing that it is free of errors, current at all times, or reachable without interruption.

The quality and turnaround commitments we make to a client are in the service agreement signed for that project. They do not arise from reading this page.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect damages connected to the use of this site, including lost profits, lost customers, lost data or lost business opportunities.

For any other damage connected to this site, our total liability does not exceed $100. For an ongoing project, the limit set in the service agreement applies instead.

These limits do not apply to bodily or moral injury, or to gross or intentional fault on our part: Quebec law does not allow anyone to contract out of those, and we do not claim to.

11. Links to other sites

This site may link to sites we do not operate. We control neither their content nor their privacy practices, and we are not answerable for them.

12. Privacy

How personal information is handled is set out in the privacy policy, which forms part of these terms.

13. Governing law

These terms are governed by the laws applicable in Quebec. Any dispute falls to the courts of the judicial district of Quebec, province of Quebec.

14. Language

These terms exist in French and in English. If the two versions differ, the French version prevails.

15. Changes

These terms can be changed. The version in force is the one shown on this page, as of the date at the top. Continuing to use the site after a change means accepting the new version.
